This software is protected by both United States copyright law and international treaty provisions.Therefore, you must treat this software just like a book, with the following single exception.Side Eight authorizes you to make archival copies of the software for the sole purpose of backing-up our software and protecting your investment from loss.

By saying, just like a book, Memorize-It for Windows may be used by any number of people and may be freely moved from one computer location to another, so long as there is no possibility of it being used at one location while its being used at another.Just like a book that cant be read by two different people in two different places at the same time, neither can the software be used by two different people on two different computers at the same time.(Unless, of course, Side Eights copyright has been violated).

QUIZZER EXCEPTION

You may use the Memorize-It Quizzer (the Memorize-It 4.0 software without a serial number or an expired trial) software FREE of charge for as long as you wish. You may distribute Memorize-It Quizzer as long as it is a "not for profit" transaction and there are no changes made to the installer, applications or data. For instance, you can create decks with Memorize-It and give them to your friends with a quizzer if they do not own Memorize-It. This does not mean you can give them your serial number, just the application so they can quiz only. This allows others to use the decks you create without infringing on Side-Eight's copyright. If you wish to sell the decks you create Side-Eight has very inexpensive licensing agreements which allow you sell your decks with a quizzer (for profit). Just contact us. We'll even modify Memorize-It to have your own art work on the splash screen.

LIMITED WARRANTY

With respect to the physical diskette and physical documentation enclosed herein, Side-Eight warrants the same to be free of defects in materials and workmanship for a period of 60 days from the date of purchase.In the event of notification within the warranty period of defects in material or workmanship, Side-Eight will replace the defective diskette or documentation.The remedy for breach of this warranty shall be limited to replacement and shall not encompass any other damages, including but not limited to loss of profit and special, incidenal, consequential, or other similar claims.

Side-Eight specifically disclaims all other warranties, expressed or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose with respect to defects in the diskette and documentation, and the program license granted herein in particular, and without limiting operation of the program license with respect to any particular application, use, or purpose.In no event shall Side Eight be liable for any loss of profit or any other commercial damage, including but not limited to special, incidental, consequential or other damages.

GOVERNING LAW

This statement shall be construed, interpreted, and governed by the laws of the State of California.Use, duplication, or disclosure by the U. S. Government of the computer software and documentation in this package shall be subject to the restricted rights under DFARS 252.227-7013 applicable to commercial computer software.Contractor/manufacturer is Side-Eight, P.
